2. What data we process and why
Contact form: name, email, phone and the message you write to us. We use them to answer your enquiry or request (for example, about buying, selling or renting a property, or a free valuation) and, if you ask us to, to provide the service.
Website chat assistant: whatever you write in the chat and, if you give them to us, your name and phone number, in order to reply. The first answers are automatic and the conversation may be handed over to a member of the team. The service is provided by LaPera Marketing on behalf of Control Immobles.
WhatsApp: if you write to us on WhatsApp using the buttons on the website, we process your number and your messages to assist you. WhatsApp is a Meta Platforms service.
Social media (Instagram and Facebook): the messages and comments you send us, in order to reply; if you leave us your phone number, to call you about the property or service you are interested in.
Browsing: this website does not use analytics or advertising tools. Third-party content (YouTube and TikTok videos, the Google Maps map) only loads if you accept it in the cookie panel. See the details in our Cookie policy.
3. Legal basis
We process your data with your consent, which you give when you send us the form or write to us via the chat, WhatsApp or social media (article 6.1.a of Regulation (EU) 2016/679, GDPR), and to take pre-contractual steps at your request, such as informing you about a property or preparing a valuation (art. 6.1.b GDPR). When the contact leads to a real estate agency mandate, processing is also based on the performance of that mandate and on the legal obligations that apply to us. You can withdraw your consent at any time.
4. Recipients
We do not pass your data on to third parties, except where required by law or where essential to manage your transaction and with your knowledge (for example, notaries, banks or processing agencies). We work with providers who process data on our behalf as data processors under the GDPR: web hosting and email, and the chat assistant (LaPera Marketing).
5. International transfers
Some services you use through the website (WhatsApp, Instagram and Facebook, from Meta; YouTube and Google Maps, from Google; TikTok) may process data outside the European Economic Area. These transfers are covered by the EU-US Data Privacy Framework or by the standard contractual clauses approved by the European Commission.
6. Retention
If your enquiry does not lead to any business relationship, we keep your data for a maximum of 12 months from the last contact. If we end up working together, we keep it for as long as the relationship lasts and then for the legal periods: up to 10 years for the documentation required by anti-money-laundering regulations (Spanish Law 10/2010) and the applicable tax and commercial periods.
7. Your rights
You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent, by writing to info@controlimmobles.com or by post to the address above. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) if you believe the processing does not comply with the regulations.
8. Security
We apply reasonable technical and organisational measures to protect your data against unauthorised access, loss or alteration.
9. Third-party links
This website contains links to social networks, to our property website and to other third-party websites. Control Immobles is not responsible for the privacy practices of those sites, which are subject to their own policies.
